Terms of Service
These terms are the contract between you and Late Bloomer. By creating an account or starting a subscription you agree to them. Plain English where possible; legal terms only where the law requires.
1. Who you're contracting with
"Late Bloomer", "we", "us", and "our" mean Nicola Doherty, sole trader, trading as Late Bloomer, of 8 Vernon Mews, Clontarf, Dublin 3, D03 X7W0, Ireland (Business Name registration with the Irish Companies Registration Office in progress).
2. Who can use Late Bloomer
- You must be at least 16 years old.
- You must have legal capacity to enter into a contract.
- You must give us accurate registration information and keep it up to date.
- The app is currently sold in Ireland and the United Kingdom only. Availability may expand later.
3. The service
Late Bloomer is a strength-training programme delivered through an iOS app. It includes:
- A 12-week progressive strength programme with daily sessions, form videos, and adaptive recommendations.
- A daily symptom check-in feature that informs the programme.
- Optional integration with Apple Health to read sleep, heart rate variability, and activity.
- Optional access to a human coach (Coached and Premium plans).
- Optional form-check video reviews (Premium plan).
We may add, remove, or change features from time to time. If a change materially reduces what you've paid for, we'll tell you and offer a pro-rata refund or plan switch.
4. Subscription plans
| Plan | Price | Includes |
|---|---|---|
| Self-Led | €25 / month | Programme, check-ins, adaptive recommendations |
| Coached | €65 / month | Self-Led + a real human coach reviewing your check-ins and messaging you |
| Premium | €175 / month | Coached + form-check video reviews |
Prices include VAT where applicable. Apple may convert prices into your local currency.
5. Billing, renewal, and cancellation
- Subscriptions are billed by Apple through your App Store account.
- Subscriptions auto-renew at the end of each billing period until cancelled.
- You can cancel any time in iOS Settings → [your name] → Subscriptions → Late Bloomer. Cancellation takes effect at the end of the current billing period.
- You keep access for the rest of the period you've paid for.
- Refunds for App Store purchases are handled by Apple — see Apple's refund process.
6. Your right of withdrawal (EU consumer law)
Under the EU Consumer Rights Directive you normally have 14 days to withdraw from a digital-services contract for a full refund. Because Late Bloomer is a digital service supplied immediately, by starting a session you expressly request that we begin performance during the withdrawal period and acknowledge that you lose the right of withdrawal once performance is complete. To request a refund, follow Apple's process linked above.
7. Equipment rental (Ireland only)
- Optional equipment rental is offered for the 12-week programme at €45 for the full term.
- You must return the equipment in the condition it was sent (fair wear and tear excepted) within 14 days of programme end.
- If equipment is damaged beyond fair wear, lost, or not returned, we may charge the replacement cost to your payment method on file.
- Rental is currently available only at addresses in the Republic of Ireland.
8. Health disclaimer
Late Bloomer is not medical advice. The programme is designed by qualified strength coaches with input from clinicians, but it is general fitness guidance and cannot replace individual medical care.
Speak with your GP or a qualified clinician before starting any new exercise programme, especially if you are pregnant, recovering from injury or surgery, have a heart condition, osteoporosis, hypertension, or any other condition that may be affected by exercise.
Stop and seek medical advice if you experience chest pain, shortness of breath, dizziness, or any sharp or persistent pain during a session.
9. Apple Health and HealthKit
If you grant Apple Health permissions, the data is used solely to inform your programme. We do not sell, share, or use HealthKit data for advertising. See our Privacy Policy for the full list of HealthKit commitments.
10. Your account, your responsibility
- Keep your login credentials secure. You're responsible for activity on your account.
- Tell us promptly if you suspect unauthorised access (hello@latebloomer.app).
- Don't share your account with someone else — each account is for one person.
11. Form-check videos and other content you submit
If you submit videos or messages to your coach, you keep ownership. You grant us a non-exclusive, royalty-free licence to store, process, and display that content solely to deliver the service to you. We will not publish or share your videos externally without your separate written consent.
12. Acceptable use
Don't:
- Use the service to harass, threaten, or abuse anyone, including our coaches and team.
- Reverse-engineer the app or attempt to bypass its security.
- Resell or redistribute access.
- Submit content that's unlawful, infringing, or sexually explicit.
We may suspend or terminate accounts that breach these rules.
13. Intellectual property
The Late Bloomer name, logo, programme design, video content, and software are owned by us or our licensors. You get a personal, limited, non-transferable, revocable licence to use the app for the duration of your subscription. No other rights are granted.
14. Termination
- You may close your account at any time from Profile → Privacy → Delete my account.
- We may suspend or terminate your account if you breach these terms, with notice where reasonable.
- On termination, the licence to use the app ends. We retain limited data for the periods set out in the Privacy Policy.
15. Limitation of liability
Nothing in these terms limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be limited or excluded under Irish or EU consumer-protection law.
Subject to that, our total liability arising out of or in connection with the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect or consequential losses.
16. Warranty disclaimer
The service is provided "as is" and "as available". Beyond the warranties that the law mandates, we don't promise the app will be error-free, uninterrupted, or that recommendations will produce specific results.
17. Changes to these terms
We may update these terms from time to time. If a change materially affects your rights we will email you at least 14 days before it takes effect, and you'll have the option to cancel. The current version lives at latebloomer.app/terms.
18. Governing law and jurisdiction
These terms are governed by the laws of Ireland. Disputes are subject to the non-exclusive jurisdiction of the Irish courts. If you live in another EU country, you keep the protection of mandatory consumer-protection laws of your country of residence and may bring proceedings there.
19. Online dispute resolution
The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not, however, obliged or willing to participate in dispute-resolution proceedings before a consumer arbitration body — please contact us first at hello@latebloomer.app and we'll do our best to sort it out.
20. Miscellaneous
- If any clause is unenforceable, the rest stays in force.
- You may not assign these terms; we may assign them to a successor entity (e.g. on incorporation as Late Bloomer Ltd.) without your consent.
- These terms, together with the Privacy Policy, are the entire agreement between us.
